These terms are between you and Kelly Green Holdings LLC, operating the DataShield service at datashieldnow.com (“we”, “us”, “DataShield”). You can reach us at [email protected].
DataShield finds contacts for supported data brokers and people search services and submits removal and opt out requests on your behalf for each eligible service period, using the information you authorize us to share. This saves you the work of finding those contacts and preparing and submitting the requests yourself. We act under your separate signed authorization.
The service covers request submission. Acceptance, removal and processing times depend on each broker and are not guaranteed. The service does not include ongoing follow up, monitoring, tracking outcomes, independent verification of removal or routine status reports. We may forward confirmations we receive, but do not promise to receive or forward every broker response.
Brokers may contact you directly for verification or additional information. Monitoring your email and completing those steps are your responsibility. We may not receive copies of those messages.
Annual billing includes the same monthly service. A monthly service period does not mean every broker receives a new request each month; prior submissions, broker procedures and applicable law determine which requests are appropriate.
Coverage is limited to the brokers and request methods we support and disclose. We do not cover every broker, website, record or jurisdiction. A free exposure check covers only the named sites shown with that check, and its results may be a possible match (shown as “Possible personal information exposed”), no match found, or unable to check. A possible match is not a verified record; it does not confirm a leak or data breach. A free check creates no account and no obligation on either side.
The core plan does not include telephone consultations, operator calls to brokers, postal submissions, litigation, legal representation, credit repair, reputation management, emergency response or identity-theft insurance. We are not a law firm and we do not provide legal advice.
Before you pay, you must verify your email, complete an identity check, and sign the current authorization and service agreement. Work requires both a verified payment and a continuing valid authorization. A payment checkbox does not replace the signed authorization.
We may ask you to correct information or complete a broker’s own verification step. Work may pause if information, authority or required verification is missing. We cannot bypass a broker’s lawful verification requirements.
Submitted, pending and confirmed-removed are different stages. A submitted request is not confirmation of removal. These limits do not excuse our failure to perform our own agreed service, and they do not restrict remedies that applicable law provides.
Managed Removal costs US $9.99 per month or US $99.89 per year, depending on the billing option you select, plus applicable taxes disclosed before payment. The annual charge is paid upfront; it is not a monthly installment plan. Signing alone does not charge you.
Your subscription automatically renews for successive monthly or annual terms, as selected, until you cancel. You authorize the disclosed recurring charges to your chosen payment method. The purchase screen identifies the selected billing period, charge and renewal terms before you authorize payment.
Price changes apply prospectively, after any required notice and consent, and do not increase the price of an already-paid term. If a payment fails, service may be suspended while the failure remains unresolved.
You may cancel future renewal through the billing portal linked from your account, or by emailing [email protected]. No telephone call is required. A cancellation received before the next renewal charge stops that renewal.
You may separately revoke your authorization through the account revocation control or by email. Revocation stops new actions that require that authority; it does not undo requests already submitted, and it does not require a broker to restore information.
If you revoke all authority needed to provide the service, we also stop future renewal charges. Revocation alone does not create a discretionary refund of the current term; statutory rights remain unaffected.
Subscription payments are not refundable except where applicable law requires otherwise. We do not provide prorated credits for mid-term cancellation, nonuse, or dissatisfaction with a broker’s response, and we offer no trial refund, satisfaction guarantee or removal guarantee.
This does not permit unauthorized charges, does not eliminate remedies for our breach or failure to provide the purchased service, and does not limit any mandatory refund, cancellation or other consumer right. Contact [email protected] about a billing error or a refund required by law. See our refund policy.
Support is provided by email at [email protected] and through any account tools we make available. No telephone support or fixed response-time commitment is included.
We may change supported methods as broker requirements change. We will not treat a material reduction of the purchased service as permission to keep charging for a service we no longer provide. Notice, cancellation, consent and refund obligations required by law continue to apply.
Where we change a price or a material term, we give notice to your account email at least 7 days before it takes effect, or longer where applicable law requires. You may cancel before the change takes effect.
Our service depends on third parties we do not control, including the data brokers and people-search services that receive requests, our payment processor, our email provider and our hosting provider.
We are not liable for delay or failure caused by a third party’s action or omission, including a broker’s refusal or failure to process a request, a payment processor’s outage, or an email provider’s suspension or rejection of our messages. Where such a failure is material and continuing, we will notify you promptly and stop charging for the affected service. This does not limit any right you have under applicable law, and it does not excuse our failure to act promptly once we know of the problem.
Our Privacy Policy describes the information used for the service, the recipients, retention and your rights. Necessary information and evidence of your authorization may be shared with supported broker recipients to process your requests.
Cancellation, revocation or a deletion request does not automatically erase records we may or must retain for consent evidence, transaction records, security, disputes or legal obligations. We retain only what is reasonably needed for those purposes.
To the extent permitted by applicable law, we disclaim implied warranties of merchantability, fitness for a particular purpose and noninfringement, beyond the express service commitments in these terms. To the extent permitted by applicable law, we are not liable for indirect, consequential, special or punitive damages, and our aggregate liability arising from the service is limited to the fees you paid us during the twelve months preceding the event giving rise to the claim.
These exclusions and this cap do not apply to fraud, willful misconduct, gross negligence, or any liability, statutory damages, refund, remedy or consumer right that applicable law does not allow us to exclude or limit. If a limitation is not permitted in your jurisdiction, it does not apply to you. These terms do not require arbitration, do not waive class proceedings, and do not prevent complaints to regulators.
If you have a problem with the service, contact us first at [email protected] and describe the issue. We will try to resolve it within 30 days. This step is not a condition of any right you have, and it does not prevent you from contacting a regulator or taking legal action at any time.
These terms are governed by the laws of the State of Maryland, except where the mandatory consumer protections of your state or country of residence provide otherwise. Nothing in this section limits a right you have to bring a claim in a forum that applicable law makes available to you.
We provide material changes and obtain consent where required by law. Changes are prospective and do not retroactively alter an accrued claim, authorize a past charge, or silently broaden your signed authorization. A material change to agency authority requires a new authorization.
If a provision is unenforceable, the remainder applies to the extent lawful. Mandatory protections of your jurisdiction remain in effect.
Order of precedence. If these terms conflict with your signed authorization, the authorization controls as to the scope of the authority you granted us. If these terms conflict with the Privacy Policy, the Privacy Policy controls as to how we handle personal information. If they conflict with the refund policy, these terms control.
Entire agreement. These terms, the Privacy Policy, the refund policy and your signed authorization are the entire agreement between us on these subjects. They replace any earlier discussion or representation on the same subjects.
Assignment. We may assign these terms to a successor entity in connection with a merger, acquisition or sale of the business, and we will notify you if we do. You may not assign your account without our written consent.
Survival. The sections on refunds, liability, privacy and records, disputes and this General section continue to apply after your account ends.
No waiver. If we do not enforce a provision on one occasion, that does not waive our right to enforce it later.
